"Kappa Mikey Skateboard Camp" Sweepstakes
(The "Sweepstakes")
OFFICIAL RULES
1. NO PURCHASE NECESSARY TO ENTER OR WIN. Void in Puerto Rico and where prohibited or restricted by law. All entries become property of Sponsors. The Sweepstakes is open to legal residents of the 48 contiguous United States (including the District of Columbia) who are between the ages of 6 and 14 at time of entry. Sweepstakes not open to employees or the immediate family members of individuals employed by MTV Networks, its parent, subsidiary and affiliated companies, cable affiliates, licensees, advertising and promotional agencies, the independent judging organization, printing agents or any other sponsors (collectively "Sponsors"), or those who have won a grand prize in any Nicktoons Network sweepstakes in the previous twelve (12) months. Entry into this Sweepstakes constitutes agreement to sign any and all legal documents which Sponsors may require.
2. Sweepstakes commences 12:00 p.m. (ET) May 21, 2007 and ends 12:00 p.m. (ET) June 10, 2007 ("Promotional Period").
3. TO ENTER:
Entries are limited to one (1) entry per person, per household, per calendar day. Get your parent's permission and complete the Sweepstakes registration form available at www.nicktoonsnetwork.com during the Promotional Period. Entrants must complete all required data. All incomplete or inaccurate entries shall be rendered void. Use of a profane username or the submission of false or misleading personal information by an entrant will be grounds for disqualification. Sponsors retain sole discretion to determine whether entry information is profane, false, or misleading. All entries must be received at www.nicktoonsnetwork.com by 12:00 p.m. (ET) June 10, 2007.
OPT OUT: The parent and/or legal guardian of each entrant will be sent a notification e-mail upon electronic submission of the online entry form confirming entry into the Sweepstakes and providing the option to withdraw entry. If the option to withdraw is not exercised within the time period indicated on such notice, the entry will be deemed submitted.
4. The concept of the Sweepstakes is as follows: Winners will be selected by National Sweepstakes Company, an independent judging organization, in a random drawing from among all eligible entries on or about June 15, 2007. Odds of winning will depend on the total number of eligible entries received. Limit one (1) prize per individual/household. Sponsors will begin notifying winners via email and/or telephone within 2 to 4 days of the drawing.
5. The prize(ing) is as follows:
Grand Prize (1): Winner will receive a four (4) day/three (3) night trip for up to four (4) to Los Angeles, CA ("Prize Package"). Prize Package will include: (i) round trip coach air transportation from the major commercial airport nearest Grand Prize winner's residence; (ii) standard hotel accommodations consisting of 1 room, (quad occupancy) for three (3) nights; (iii) up to 4 hours of a private skateboard lesson with a certified skateboard instructor at a training facility in or around Los Angeles, CA; and (iv) a custom Kappa Mikey skateboard and protective gear (helmet, knee and elbow pads). Total Approximate Retail Value (ARV) of Grand Prize is $5,700.00. Total ARV of Grand Prize may vary depending on point of origin of Grand Prize Winner.
California Residents: (a) If Grand Prize Winner resides within a sixty (60) mile radius of Los Angeles, CA ("local residence"), in lieu of the round trip coach airfare portion of the Prize Package, the Winner and Guests will receive transportation a form of which shall be the Sweepstakes Entities choice for Winner and Guests to and from Winner's local residence to the hotel. Total ARV of local residence Prize Package is $700.00. No compensation will be awarded in lieu of the difference in the total ARV.
Grand Prize package does not include daily transportation to and from the hotel, gratuities, meals and other incidentals not specifically stated. Sponsors reserve the right, in their sole discretion, to substitute any element of the Prize Package with a prize of equal or greater value.
If Winner resides in the State of California, Winner agrees to waive any and all right that they or any party claiming by, through or for them have, have had, may now have or hereafter will have under the provision of Section 1542 of the civil Code of the State of California and any similar provision in any other jurisdiction. Section 1542 provides as follows:
"A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing a release, which if known by him or her must have materially affected his or her settlement with the debtor."
Grand Prize winner must be in good health (e.g., no heart or other physical problems that might prevent him or her from participating in the skateboard lessons portion of the Grand Prize.) Parent or legal guardian will be required to sign a consent form for the Grand Prize winner to participate in activities at the training facility.
Grand Prize Winner and guest(s), must travel with a parent or legal guardian on dates to be determined solely by Sponsors. Dates are subject to change by Sponsors. All travel arrangements and accommodations are at discretion of Sponsors. Grand Prize package does not include daily transportation to and from the hotel, gratuities, meals and/or other incidentals not specifically stated.
First Prize(s) 10: Custom Kappa Mikey skateboard and protective gear (helmet, knee and elbow pads). ARV $2,000.00
Total ARV of all Sweepstakes prizing is: $7,700.00
6. Winner Notification and Qualification:
Potential Winners: Two (2) to four (4) days following the drawing, Sponsors will attempt to contact the Potential Winners via phone and/or email. No messages will be left on machines. Each Potential Winner (or their parent or legal guardian) must respond to the Sponsors by phone or email within five (5) business days of Sponsors' notification, or will be subject to disqualification. If a Potential Winner (or their parent or legal guardian) fails to respond within stated time period, that Potential Winner will be disqualified and an alternate Potential Winner will be selected at random from among all of the remaining eligible entries.
All prizes are non transferable and have no cash equivalent, except as indicated herein. Grand prize will be considered taxable income and will be awarded in the name of the winner's parent or legal guardian. Merchandise cannot be returned for cash. Substitution of prizes by winners is prohibited. Sponsors reserve the right in their sole discretion to substitute any prize with a prize of comparable value.
In order for Potential Winner to be declared an Official Winner, he/she (or his/her parent or legal guardian) must prove eligibility to Sponsors' satisfaction within five (5) days of Sponsors sending the legal documents which Sponsors may require (including a W-9 tax form). In addition, Winner (or his/her parent or legal guardian) will be required to sign an affidavit: (i) releasing Sponsors from any and all liability, claims, demands and causes of action for personal injury, death and/or damage, theft, or loss suffered in connection with this Sweepstakes, or the use or acceptance of the prizes or any portion thereof to be eligible for the Prize; and (ii) where permitted by law, granting Sponsors the right to use his or her name, voice and likeness for advertising and publicity purposes without additional compensation. In addition, Grand Prize Winner and guests must sign a travel release prior to ticketing, and will be required to provide a signed affidavit of eligibility and compliance with official rules and any and all legal documents which Sponsors may require before being deemed the Official Winner. Noncompliance with the above noted requirements will result in disqualification and the selection of an alternate Winner. Prize will not be awarded until such requirements are met.
Upon receipt of the Prize, Official Winner (or their parent or legal guardian) is required to comply with any and all applicable federal, state and local laws, rules and regulations. The value of the Prize is taxable as income, and the Official Winner is solely responsible for all matters relating to the Prize, including, but not limited to, all applicable federal, state and local taxes that become due with respect to the Prize. In the event, (i) a Winner chooses not to accept his/her prize, (ii) does not comply with these Official Rules, or (iii) Sponsors are unable to contact a Winner, or notification of Prize is returned as undeliverable, Prize will be forfeited in its entirety and awarded to an alternate Winner randomly selected from all of the remaining entries.
Sponsors are not responsible for any problems or technical malfunctions, human error, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer on-line systems, servers or providers, computer equipment, software, failure of entrants on account of technical problems or traffic congestion on the internet or at any web site or any combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials contained in this Sweepstakes. If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of the Sponsors which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsors reserve the right at their sole discretion to cancel, terminate, modify or suspend the online portion of the Sweepstakes. Should the Sweepstakes be terminated or cancelled prior to the stated expiration date, notice will be posted on the website, and any entries received prior to the termination or cancellation will be included in the drawing. Entries that have been tampered with or altered will be deemed void. In the event that a Winner entered via online and there becomes a dispute over who submitted the winning entry, the holder of the winning email address will be declared the Winner. The use of any system or agent to submit online entries in connection with this Sweepstakes is prohibited and will result in disqualification. Collection and use of personally identifiable information will be in accordance with the Nicktoonsnetwork.com Privacy Policy as posted on Nicktoonsnetwork.com.
7. By entering, participants (and their parent or legal guardian) acknowledge compliance with these official rules including all eligibility requirements. By participating in this Sweepstakes, entrants (or their parent or legal guardian) agree to be bound by these Official Rules and the decisions of the judges and Sponsors, which are final in all matters relating to this Sweepstakes.
8. All interpretations of the rules and decisions by Sponsors are final. Sponsors reserve the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or any web site associated therewith; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A SWEEPSTAKES ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS AND THEIR DESIGNEES RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH SWEEPSTAKES ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
